1. Introduction and Acceptance of Terms

Welcome to Voicify ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the Voicify mobile application (the "App"), available on iOS and Android platforms, and our website at voicifyai.app (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE.

1.1 Apple App Store Distribution

Important Notice for iOS Users: If you obtained this App from the Apple App Store, you acknowledge and agree that:

• Apple, Inc. and Apple's subsidiaries are third-party beneficiaries of these Terms
• Apple has the right to enforce these Terms against you
• These Terms are between you and Voicify only, not with Apple
• Apple is not responsible for the App, its content, maintenance, or support services

Voicify is a voice-first mobile application that transforms voice recordings into actionable knowledge through:

• Voice Recording: High-fidelity audio capture and storage
• AI-Powered Transcription: Automatic speech-to-text conversion
• Intelligent Summaries: AI-generated summaries of your recordings
• Secure Storage: End-to-end encrypted cloud storage
• Organization: Folder-based content management
• Cross-Device Sync: Access your recordings across multiple devices

3. Eligibility

3.1 Age Requirements

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3.2 Geographic Restrictions

The Service is available worldwide, subject to local laws and regulations. You are responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction.

4. Account Registration and Security

4.1 Account Creation

To access certain features of the Service, you must create an account using one of the following authentication methods:

• Google OAuth: Sign in with your Google account
• Apple Sign In: Sign in with your Apple ID

4.2 Account Responsibility

You are solely responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your login credentials
• Any content created, uploaded, or shared through your account
• Notifying us immediately of any unauthorized access or security breach

4.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent Service limitations (including free tier quotas) is strictly prohibited and may result in account suspension or termination.

5. Subscription Plans and Pricing

5.1 Service Tiers

Voicify offers the following subscription tiers:

• Subscriptions are processed through RevenueCat and billed via your Apple App Store or Google Play Store account
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your App Store or Google Play Store account settings

6. Quota Enforcement and Fair Use

6.1 Free Tier Quotas

• Free tier users are limited to 2 recordings per day
• Daily quotas reset at midnight UTC
• Quotas are enforced per user account across all devices
• Server-side validation prevents quota manipulation

6.2 Fair Use Policy

All users, regardless of subscription tier, must:

• Use the Service for personal or legitimate business purposes only
• Not abuse, overload, or exploit the Service infrastructure
• Not use automated systems or scripts to create excessive recordings
• Not share accounts or authentication credentials with others

7. Payment Terms and Refunds

7.1 Payment Processing

• All payments are processed through Apple App Store or Google Play Store
• Payment terms are subject to the applicable App Store's terms and conditions
• We do not directly process or store your payment information

7.2 Refund Policy

• Refund requests must be submitted through the Apple App Store or Google Play Store
• Refunds are subject to the policies of your respective App Store
• We do not have the ability to issue refunds directly
• Approved refunds will result in immediate loss of subscription benefits

8. User Content and Data

8.1 Your Content

"Your Content" means any audio recordings, transcriptions, summaries, folders, and other data you create, upload, or store using the Service.

8.2 Ownership

• You retain all ownership rights to Your Content
• You grant us a limited license to process, store, and display Your Content solely to provide the Service
• This license is non-exclusive, worldwide, royalty-free, and terminates when you delete Your Content or close your account

8.3 Data Security

We implement industry-standard security measures including:

• End-to-End Encryption (E2EE): Your recordings are encrypted before leaving your device
• Secure Storage: Data stored on Supabase with enterprise-grade security
• Access Controls: Role-based access and authentication
• Encrypted Transmission: All data transmitted over secure HTTPS connections

12. Acceptable Use Policy

12.1 Permitted Uses

You may use the Service to:

• Record personal voice notes and reminders
• Transcribe meetings, interviews, and lectures (with consent)
• Create audio journals and diaries
• Organize and manage audio content

12.2 Prohibited Activities

You may not:

• Use the Service for any unlawful purpose
• Record conversations without required consent under applicable wiretapping or privacy laws
• Attempt to gain unauthorized access to the Service or related systems
• Use automated systems (bots, scrapers) without permission
• Introduce viruses, malware, or harmful code
• Impersonate any person or entity
• Harass, threaten, or harm other users

13. Disclaimers and Limitations of Liability

13.1 Service Provided "AS IS"

The service is provided on an "as is" and "as available" basis without warranties of any kind.

13.2 Transcription Disclaimer

Speech-to-text transcription is provided by third-party AI services and may contain errors due to audio quality, accents, background noise, or technical terminology. You should review all transcriptions for accuracy before relying on them for important purposes.

13.3 Limitation of Liability

In no event shall our total liability to you for all claims exceed the greater of $100 USD or the amount you paid us in the 12 months preceding the claim.

15. Account Termination and Deletion

15.1 Your Right to Delete Your Account

In compliance with Apple App Store and Google Play Store requirements, you have the right to initiate account deletion directly within the App at any time without contacting customer support.

15.2 What Happens When You Delete Your Account

Upon account deletion:

• Your account access is revoked immediately
• All recordings, transcriptions, and summaries are permanently deleted within 30 days
• Backup copies may persist for up to 90 days for disaster recovery, then permanently deleted
• Account deletion is permanent and cannot be undone

16. Dispute Resolution

16.1 Informal Resolution

Before filing a formal claim, you agree to contact us at support@voicifyai.app to attempt to resolve the dispute informally.

16.2 Arbitration Agreement

Please read carefully: This affects your legal rights.

You and Voicify agree that any dispute will be resolved by binding arbitration rather than in court, except for small claims court actions and injunctive relief for intellectual property infringement.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

For disputes not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notification, email, or prominent website notice. Continued use of the Service after changes take effect constitutes your acceptance of the modified Terms.

21.1 Apple App Store Requirements

If you download the App from the Apple App Store:

• These Terms are between you and Voicify only, not with Apple
• Apple has no obligation to furnish maintenance or support services
• In case of failure to conform to warranty, you may notify Apple for a refund
• Voicify, not Apple, is responsible for addressing any claims
• Voicify is solely responsible for intellectual property infringement claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms

21.2 Google Play Store

If you download the App from Google Play, you acknowledge that these Terms are between you and Voicify, not Google. Google has no obligation or liability regarding the App.

26. California-Specific Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

• Right to Know: Request information about data collection and use
• Right to Delete: Request deletion of your personal information
• Right to Opt-Out: Opt out of sale of personal information (we do not sell data)
• Non-Discrimination: We will not discriminate against you for exercising your rights

If you are located in the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR):
